Session Description: This presentation will focus on the current status of the EEOC v. Yale New Haven Hospital litigation related to late career provider policies. It will discuss the history and present state of the litigation, the varying positions of the parties and the relevant legal concepts at issue. The latter will include review of other industries that have imposed age-based retirement or screening requirements when public safety is at issue. It will cover the potential impact the outcome of this case might have on medical staffs across the country and the implications of differing outcomes in the trial. While the presentation is in lecture format, the speakers hope to invite the audience to share their own experiences, insights, and engage in discussion on some of the critical issues related to this topic (e.g., permitting such policies during a nationwide provider shortage, the value of experience versus the decline in cognitive function, and the difference (if any) between a patient and passenger).
